K law, a law firm established under Belgian law in the form of a cooperative company with limited liability (CVBA/SCRL), having its registered office at Brussel Nationaal Luchthaven 1K, 1930 Zaventem and registered with the Register of Legal Entities (Brussels) under the number 0844.900.979 (hereinafter, “K law”) processes as data controller the personal data you provide through this web based platform (contact details, professional information and/or any other personal data that you may provide) and for which you shall remain solely responsible, for recruitment and selection purposes.
K law will process your personal data in order to:
§ Process and manage your job application, whether it is spontaneous or related to a job opening (legal basis : Processing necessary to take steps at your request prior entering into a contract – article 6.1 b) of GDPR)
§ Add your profile in our “reserve list” of candidates for future possible roles within K law or a Belgian KPMG entity (https://home.kpmg/be/en/home/misc/belgian-kpmg-entities.html) (legal basis :Processing necessary for the purposes of the legitimate interests pursued by K law (namely to assess and evaluate your profile before deciding on entering into a potential contract) – article 6.1 f) of GDPR
§ In case of hiring, prepare your (employment) contract and manage your personal file as a new member of K law or a Belgian KPMG entity. (legal basis : Processing necessary for the performance of a contract to which you are party – article 6.1 b) of GDPR)
§ If needed, invite you to complete an assessment and integrate your results into the platform (legal basis : Processing necessary to take steps at your request prior entering into a contract – article 6.1 b) of GDPR)
In the context of this processing, K law will call on the data processor KPMG Central Services, Economic Interest Grouping, having its registered office at Brussel Nationaal Luchthaven 1K, 1930 Zaventem and with registration number 0473.719.789 (hereinafter, “KPMG”) for managing the recruitment process. Your personal data may be shared with the Belgian KPMG entities[i] in order to match your application with available job openings.
KPMG will call on the data sub processor TALENTSOFT SA, having its registered office at 8 Rue Heyrault, 92100 Boulogne, France and with registration number 497 941 377 (hereinafter, “TALENTSOFT”) for providing and operating the platform. Your personal data will exclusively be processed in the European Economic Area and will not be transferred to any other third party than the subcontractors engaged by TALENTSOFT.
For some application, KPMG will transfer some of your personal data (first name; last name; email address (first name, last name and email address) to external suppliers who provide KPMG with assessment web tools in order to match your profile with the job you have applied for. In this context, your personal data may be processed by some entities located in the United States of America. Your personal data will be kept for the following period of time depending on purpose:
§ Process and manage your job application, whether it is spontaneous or related to a job opening. Maximum two (2) years after your last application, unless you give your consent for an additional period of two (2) years
§ Add your profile in our “reserve list” of candidates for future possible roles within K law or a Belgian KPMG entity. Maximum two (2) years after your last application, unless you give your consent for an additional period of two (2) years
§ In case of hiring, prepare your (employment) contract and manage your personal file as a new member of K law or a Belgian KPMG entity. In accordance with the legal applicable retention period (maximum ten (10) years after the termination of your (employment) contract)
§ If needed, invite you to complete an assessment and integrate your results into the platform. In case of unsuccessful application, maximum two (2) years after completing the assessment, unless you give your consent for an additional period of two (2) years. In case of successful application, in accordance with the legal applicable retention period (maximum ten (10) years after the termination of your (employment) contract)
You have the right to access, rectify and erase your personal data as well as to restrict or object the processing of your personal data. Besides that you have the right to data portability. You also have the right to withdraw your consent at any moment. The withdrawal of you consent shall not affect the lawfulness of processing based on your consent before its withdrawal. You can exercise these rights by sending an e-mail to the data protection officer at dpo@klaw.be and only insofar reasonably possible and allowed by applicable law.
Finally, we inform you that you have the right to lodge a complaint with the Belgian Data Protection Authority should any of your rights be violated.
